This website is operated by Greg Neill & Son Fine Jewellers (“we”, “us”, “our”). By accessing our site or purchasing from us, you (“you”, “customer”) agree to these Terms of Service (“Terms”), our Privacy Policy, and any policies referenced here or available by hyperlink.

We may update these Terms at any time by posting changes on this page. Your continued use of the site or Services after changes are posted means you accept those changes.

Our store is hosted on Shopify Inc., which provides the e-commerce platform that enables us to sell products and services to you.

1. Online Store Terms

  • You confirm you are at least the age of majority in your state or territory, or you have consent from a parent or guardian.

  • You will not use our products for any unlawful purpose or violate any laws in your jurisdiction.

  • You must not transmit viruses, malware, or harmful code.

  • A breach of these Terms may result in immediate termination of Services.

  • Except for credit card details, content may be transferred unencrypted and adapted to technical requirements of networks and devices. Credit card information is always encrypted during transfer.

  • We may modify or discontinue the Service (or any part) without notice.

  • We are not liable for any modification, price change, suspension, or discontinuance.

5. Products and Services

  • Certain items may be available exclusively online and may have limited quantities. Returns or exchanges follow our Refund Policy.

  • We make every effort to display product colours and images accurately. Display settings may vary by device.

  • We may limit sales to any person or region, limit quantities, or discontinue products at any time.

  • Descriptions and pricing may change without notice.

  • We do not warrant that products or Services will meet your expectations, or that errors will be corrected.

6. Custom & Made-to-Order Pieces

  • Custom designs, engraved items, resized pieces, and made-to-order jewellery are final sale except where required by law (including your rights under the ACL).

  • Lead times are estimates. We will communicate delays promptly.

  • Design approvals (including CAD renders and 3D printed prototypes) must be confirmed in writing before production.

  • Natural and lab-grown gemstones may vary in colour, clarity, and carat within stated tolerances. We follow industry grading standards and disclose treatments where known.

7. Accuracy of Billing and Account Information

  • We reserve the right to refuse or cancel any order, limit quantities per person/household/order, and restrict orders by account, card, or address.

  • If we adjust or cancel an order, we may attempt to contact you using the details provided at checkout.

  • You agree to provide current, complete, and accurate purchase and account information, and to update details promptly so we can complete transactions and contact you if needed.

8. Pricing, Currency & Taxes

  • All prices are in AUD unless stated otherwise and include GST where applicable.

  • International orders (if available) may attract duties, taxes, or fees imposed by the destination country. These are your responsibility.

9. Shipping, Risk & Title

  • Shipping options, costs, and delivery windows are presented at checkout.

  • Risk in goods passes to you on delivery to your nominated address or collection point. Title passes upon full payment.

  • We recommend a secure delivery address and signature on delivery for higher-value items.

10. Lifetime Guarantee & Warranties

  • Where noted, engagement rings over AUD $2,000 include our Lifetime Diamond Guarantee. The guarantee covers manufacturing faults when jewellery is used under normal conditions.

  • The guarantee does not cover loss, theft, accidental damage, wear and tear, or misuse. Prongs and settings can wear over time and require routine maintenance.

  • Keep your proof of purchase and schedule regular inspections. Your statutory rights under the Australian Consumer Law (ACL) are not limited by any additional guarantee.

11. Optional Tools and Third-Party Services

  • We may provide access to third-party tools or services “as is” and “as available” without warranties. Use is at your own risk and subject to third-party terms.

  • New features and services may be added and will be subject to these Terms.

12. Third-Party Links

  • Third-party links may direct you to sites not affiliated with us. We are not responsible for examining or evaluating third-party content and assume no liability for materials, products, or services of third parties.

  • Review third-party policies before engaging in any transaction.

13. User Content (Comments, Reviews, Submissions)

  • If you submit ideas, reviews, images, or other materials (“Comments”), you grant us a non-exclusive, royalty-free, transferable licence to edit, copy, publish, translate, distribute, and use such content in any medium.

  • We have no obligation to maintain Comments in confidence, compensate you, or respond.

  • You warrant that your Comments do not infringe third-party rights or contain unlawful, abusive, or obscene material, malware, or false information.

14. Personal Information

  • Your submission of personal information is governed by our Privacy Policy. Please review it to understand how we collect, use, and protect your data.

15. Errors, Inaccuracies, and Omissions

  • Occasionally there may be errors related to product descriptions, pricing, promotions, offers, shipping charges, transit times, and availability.

  • We reserve the right to correct errors and update or cancel orders if information is inaccurate, including after an order is submitted, as permitted by law.

  • Nothing in these Terms limits your rights under the Australian Consumer Law. Where the ACL applies, our liability is limited to the remedies required by law (for example, repair, replacement, or refund, at our option as permitted).

19. Indemnification

You agree to indemnify, defend, and hold harmless Greg Neill & Son Fine Jewellers and our officers, directors, employees, affiliates, agents, contractors, licensors, service providers, and suppliers from any claim or demand arising out of your breach of these Terms or violation of any law or third-party right.

20. Force Majeure

We are not liable for delay or failure to perform due to events beyond our reasonable control, including acts of God, natural disasters, war, strikes, supply chain disruptions, or utility failures.

21. Severability

If any provision of these Terms is found unlawful, void, or unenforceable, that provision is severed to the extent required. The remainder stays in effect.

22. Termination

  • These Terms remain in effect unless terminated by you or us.

  • You may terminate by ceasing to use the site and notifying us.

  • If we believe you have breached these Terms, we may terminate your access immediately. Obligations accrued up to termination survive.

3. Entire Agreement; No Waiver

These Terms, together with posted policies (including the Privacy Policy and Refund Policy), form the entire agreement between you and us and supersede prior communications. Our failure to enforce any right does not waive it.

24. Governing Law; Jurisdiction

These Terms and any separate agreements under which we provide Services are governed by the laws of Queensland, Australia, and the Commonwealth of Australia. You submit to the non-exclusive jurisdiction of the courts of Queensland.
